Section 1 - Personal and Buddy Training Payment Plans (Including Running and Speed Coaching)

Automatic Payment Plans

 

  • When you sign up for a payment plan, payments will be automatically taken from your chosen bank account by your payment processor of choice until cancelled.

Offline Payments

  • If you choose to pay by bank transfer, please ensure that you make payment before your session.

Stopping Training

 

  • Please give To Be Personal Training 2 weeks’ notice of stopping training unless on medical grounds.

 

Cancelling Sessions

  • I ask for 48 hours' notice for cancelled sessions. You may reschedule such sessions subject to my availability. For cancellations within 48 hours of scheduled sessions, I still expect payment.

  • You may cancel scheduled sessions less than 48 hours prior if the cancellation is because of an injury, illness or emergency that occurred less than 48 hours before the session was scheduled to start.


Section 2 - Personal and Buddy Training Single Sessions (Including Running and Speed Coaching)

 

Online Payment

 

  • When you sign up for payment online, payment will be automatically taken from your chosen bank account by your payment processor.

Offline Payments

  • If you choose to pay by bank transfer, please ensure that you make payment before your session.

 

Cancelling Sessions

  • I ask for 48 hours' notice for cancelled sessions. You may reschedule such sessions subject to my availability. For cancellations within 48 hours of scheduled sessions, I still expect payment.

  • You may cancel scheduled sessions less than 48 hours prior if the cancellation is because of an injury, illness or emergency that occurred less than 48 hours before the session was scheduled to start.

 

Section 3 - Primaletix Boot Camps Payment Plans

 

Period

 

  • You acknowledge and agree to pay the dues specified in the payment plan details. You agree to be liable for dues for the entire payment plan period regardless of usage or any change of circumstance.

 

Renewal

 

  • After the initial payment plan term has expired, your payment plan will automatically renew until you change your payment plan in your login area or contact To Be Personal Training in writing to cancel. 

  • When your payment plan automatically renews, you acknowledge and agree to pay the dues specified in your new payment plan for the full duration of the new payment plan.

  • You are responsible for all charges billed or incurred prior to cancellation. To prevent such charges, ensure that you contact To Be Personal Training to cancel your renewal prior to your payment plan renewal date.

 

Pausing

 

  • You acknowledge that your payment plan will not be paused unless on medical grounds.

  • To terminate your payment plan on medical grounds, you must provide To Be Personal Training with documentation from a qualified medical practitioner certifying that you are unable to take part in an exercise regime for a period of 4 weeks or more.

 

Termination (During Payment Plan Period)

  • You have the right to cancel the payment plan within 14 days from the start of the payment plan without giving any reason. You will still be charged for services received during the period prior to cancellation.

  • After 14 days, you understand that your payment plan, and any subsequent payment plan renewals, may not be cancelled for the duration of the payment plan at any time unless on medical grounds.

  • To terminate your payment plan on medical grounds, you must provide To Be Personal Training with documentation from a qualified medical practitioner certifying that you are unable to take part in an exercise regime for a period of 4 weeks or more.

  • In addition to any rights and remedies it may otherwise have, To Be Personal Training may terminate your payment plan upon 10 days written notice to you if you fail to comply with your obligations under this agreement and do not cure any such failure within 10 days after receiving notice of such failure.

 

Changes of Times and Locations

 

  • To Be Personal Training reserves the right to change its class times and locations. If you are adversely affected by any changes, you may terminate your payment plan by giving written notice to To Be Personal Training.

 

Children and Dogs

 

  • If children and dogs are brought to group training sessions, they must be well-behaved and maintain a good distance from other To Be Personal Training customers. They are not to use To Be Personal Training property and/or equipment.

 

Section 4 - Total Home Fitness

 

Period

  • You acknowledge and agree to pay the dues specified in the payment plan details. You agree to be liable for dues until cancellation or completion of your payment plan regardless of usage or any change of circumstance.

 

Termination

  • You have the right to cancel the payment plan within 14 days from the start of the payment plan without giving any reason. You will still be charged for services received during the period prior to cancellation (this includes the set-up fee).

  • After 14 days, you understand that your payment plan may be cancelled at any time from your dashboard. Partial refunds will not be given if you cancel midway through a month's payment cycle.

  • In addition to any rights and remedies it may otherwise have, To Be Personal Training may terminate your payment plan upon 10 days' written notice to you if you fail to comply with your obligations under this agreement and do not cure any such failure within 10 days after receiving notice of such failure.

 

Restrictions

  • Total Home Videos are for private personal use only. You are not allowed to use the videos commercially or for the training of groups. You are also not allowed to share your account with other people.

  • You are not permitted to download or save videos for use without a subscription.

Section 5 - All Payment Plans

 

Attitude

  • You agree to act in a considerate and respectful way to staff and other customers of To Be Personal Training.

  • Discriminatory or bullying behaviour is not tolerated.

  • You agree to behave in a manner that does not negatively impact the training of other customers.

 

Health and Safety

 

  • You agree to exercise in a manner that is safe for you and others. If you feel that this is not possible, you agree to inform a member of To Be Personal Training staff promptly.

 

Provisions of Information

 

  • It is your responsibility to ensure that your personal details are kept up-to-date and accurate.

 

Individuals Under the Age of 16

 

  • Under 16s must have a parent or guardian sign this agreement on their behalf.

  • Under 16s must be accompanied by a parent or guardian during training sessions.

 

Public Holidays

 

  • To Be Personal Training does not conduct training sessions on public holidays.

  • There will be no reimbursement if your group fitness class falls on a public holiday unless this public holiday falls during a close-down period.

  • Personal training members are encouraged to rearrange their sessions. If this is not possible, refunds will be offered.

 

Close-Down Periods

 

  • To Be Personal Training will occasionally 'close down' for staff holidays. Your payment plan will be paused during these close-down periods. You will be alerted to these close-down periods well in advance.

 

Amendments

  • To Be Personal Training reserves the right to change this member agreement.

  • For minor changes, you will be notified of the amendments via email.

  • For more significant changes, you will be notified 4 weeks in advance.

 

Transfer

 

  • You agree that your payment plan benefits are exclusive to you and are in no way transferable to anyone else.

Weather

  • I am able to conduct effective training sessions in most weathers. If it's cold, we wear more clothing. If it's hot, we wear less clothing and find shade. If it's wet, we wear suitable clothing or train under shelter. Consistency is important with exercise so we need to be pragmatic and adaptable. That said, there are times when it can be dangerous to train (e.g. extreme heat or icy conditions). In these circumstances, we cancel and rearrange your session.

Sessions I Cancel

  • I pride myself on my consistency and reliability, but I am occasionally unable to train. In such circumstances, I will endeavour to reschedule your session. If this is not possible, you will not be charged.

 


Section 6 - Payment

 

Fee Collection

  • You acknowledge that the billing information provided is accurate.

  • You acknowledge that the administration of fee collection is conducted by payment processing companies on behalf of To Be Personal Training. 

 

Late Payment

  • You will pay a service charge of £20.00 for any payments 5 days past due in addition to any and all recovery charges incurred.

  • You agree that if To Be Personal Training is unable to process my payment from the designated account provided by you, To Be Personal Training is permitted to use any of your other account information provided as many times and as often as needed to replace the unpaid payments and service charges detailed in this agreement.


Fee Changes

  • To Be Personal Training reserves the right to change its fees.

  • You will be notified of changes at least 4 weeks in advance.
